Welcome to Waypoint Coins, where adventure awaits around every corner! Before embarking on your journey with our Hide and Seek coins, please take a moment to review the following Rules. Remember, the journey is just as important as the destination – so have fun exploring and discovering with Waypoint Coins!

 

1. Safety First: While our Hide and Seek coins are designed to spark excitement and exploration, please prioritize safety at all times. You must be aware of your surroundings, especially when participating in outdoor activities or visiting unfamiliar locations.

 

2. Respect for Property: When hiding or seeking coins, always respect private property and adhere to local laws and regulations. You must avoid trespassing or causing any damage to property in your quest for treasure.

 

3. Hidden Treasure Responsibility: If you choose to hide a coin for others to find, please ensure that it is placed in a safe and appropriate location accessible to all participants. You must avoid locations that may pose risks to safety or require dangerous maneuvers to reach.

 

4. Community Collaboration: To fully enjoy the treasure hunting experience, we encourage you to join the Treasure Hunt community within the Waypoint Coins app. This allows you to share clues, hints, and discoveries with fellow adventurers, fostering a spirit of collaboration and camaraderie. But you are not required to use the Waypoint Coins app.

 

5. Intended Use: The Waypoint Coins app and associated features, including Hide and Seek coins, are intended for entertainment purposes only. We do not guarantee the accuracy or reliability of any information provided within the app, including clues or locations shared by Waypoint Coins or users.

 

6. Parental Supervision: For younger adventurers, you must have parental supervision while using the Waypoint Coins app and participating in treasure hunts. This ensures a safe and enjoyable experience for all participants.

 

7. Assumption of the Risk: By participating in Waypoint Coins events, looking for Hide and Seek Coins, engaging in Waypoint geocaching events or activities, you assume all risk risks related to or arising from such activities and waive any claims that arise from your participation in such events or activities.  You understand and agree that your safety is your responsibility and not the responsibility of anyone else, including Waypoint Coins.

 

8. By using the Waypoint Coins app and engaging with our Hide and Seek coins, you acknowledge and agree to:

(a) abide by all terms in these Rules and in our Privacy Policy, as each may be amended from time to time by Waypoint Coins in its sole discretion;

 

(b) not participate in any class action claims against Waypoint Coins or any other of the Indemnified Parties (defined below); you must file any claim against such parties individually, and you expressly waive all rights to bring, represent, join or otherwise maintain a class action, collective action, or similar proceeding against any of the Indemnified Parties in any forum; and

 

(c) defend, indemnify, and hold harmless Waypoint Coins and its related companies, and all of the foregoing parties’ respective past, present, and future owners, officers, directors, managers, employees, agents, and insurers (all of the foregoing collectively being the “Indemnified Parties”) to the fullest extent allowed by law from and against all costs, losses, claims, demands, suits, actions, payments, and judgments, including all attorney’s fees (collectively, “Losses”), arising out of any action or inaction by Waypoint Coins or related to Waypoint Coins in any way, even if the Indemnified Parties knew, have been advised of, or should have known of the possibility of such Losses. This includes but is not limited to claims regarding personal/bodily injury and/or property damage. You also agree to indemnify the Indemnified Parties to the fullest extent allowed by law from all third-party claims caused in whole or in part by you.

 

9. Any claim brought against any of the Indemnified Parties arising out of any action or inaction by Waypoint Coins or related to Waypoint Coins in any way shall be exclusively subject to binding arbitration in the Overland Park, Kansas metropolitan area according to the then-current rules of the AAA and shall be subject to the laws of the state of Kansas, without regard to conflict of laws. All parties irrevocably submit to such arbitration. ALL PARTIES WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, THE RIGHT TO TRIAL BY JURY IN ANY ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF any action or inaction by Waypoint Coins or related to Waypoint Coins in any way.

 

10. Your sole remedy if you do not wish to accept the requirements of these Rules and our Privacy Policy is to not Hide or Seek coins and to not use the Waypoint Coins app.
